Terms and Conditions

These terms and conditions ("Terms") govern the provision of online coaching services ("Services") by Lifespark Health, a C-corp registered under the laws of Delaware, with its principal place of business at 600 Market St. Suite 260 Chanhassen, MN 55317 

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Services.

1. Services

1.1. Description: Our Services entail providing online coaching sessions to teenagers via Google Meet. These sessions are facilitated by certified coaches employed by Positive Presence Global in partnership with Lifespark Health.  .

1.2. Scope: The Services include one-on-one coaching sessions, group coaching sessions, workshops, seminars, and any other related coaching activities deemed necessary for the development and well-being of teenagers.

2. Eligibility

2.1. Age: Our Life Coaching Services and personal development features are intended for teenagers and young adults between the ages of 12 and 24. By accessing or using our Services, you affirm that you are within this age range.

2.2. Consent: For individuals under the age of 18, parental or guardian consent is required to access and participate in our coaching sessions.

3. Parental Involvement

3.1. Parental Awareness: Parents or legal guardians of teenagers participating in our coaching sessions will be informed of session schedules and any relevant information pertaining to the coaching process.

3.2. Involvement: Parents or legal guardians may be involved in the coaching process and have access to the real-time chat capability to communicate with coaches and their teenagers.

4. Scheduling and Cancellations

4.1. Scheduling: Coaching sessions will be scheduled at mutually convenient times between the coach, the student, and where applicable, the parent or legal guardian. Scheduling will be conducted via email or the real-time chat platform.

4.2. Cancellations: In the event of a cancellation, we require at least a 12 hour  notice. Failure to provide sufficient notice may result in forfeiture of the session.

5. Confidentiality

5.1. Confidential Information: We respect the confidentiality of our clients and their personal information. All information shared during coaching sessions will be kept confidential unless disclosure is required by law.

5.2. Exceptions: Confidentiality may be breached in cases where there is a risk of harm to the client or others, or when required by law.

6. Data Protection

6.1. Privacy: Lifespark Health is committed to protecting the privacy of our clients. We collect and process personal data in accordance with applicable data protection laws and our Privacy Policy.

6.2. Data Usage: Any personal data collected during the provision of our Services will be used solely for the purposes of delivering and improving our coaching services. We will not disclose or sell personal data to third parties without explicit consent, except as required by law.

7. Real-Time Chat

7.1. Communication: A real-time chat capability will be provided for coaches, students, and parents to freely communicate anytime of the day within the platform provided by Lifespark Health.

8. Monitoring and Auditing

8.1. Inappropriate Behavior: Lifespark Health reserves the right to monitor and audit the use of the Services to ensure that inappropriate behavior, including but not limited to harassment, discrimination, or violation of our Code of Conduct, is not occurring. We may take appropriate action, including the termination of access to the Services, in cases of such behavior.

9. Limitation of Liability

9.1. Disclaimer: While we strive to provide effective coaching services, we cannot guarantee specific outcomes or results.

9.2. Limitation: In no event shall Lifespark Health nor its partners be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our Services.

10. Governing Law

10.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Delaware. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts of Delaware.

11. Amendments

11.1. Modification: We reserve the right to modify or revise these Terms at any time. Any changes will be effective immediately upon posting on our website or notifying users through other means.
